Terms & Conditions

The following General Terms and Conditions (GTC) apply to all contracts for coaching services between Anna Weinberger, MA (hereinafter "Coach") and her clients (hereinafter "Client").

1. Scope of Application

These GTC apply to all coaching services, consultations, workshops, and other services offered and provided by Anna Weinberger, MA — both in person and online. Any deviating conditions of the Client shall only be recognised if expressly agreed in writing.

2. Conclusion of Contract

A contract is concluded when the Client books a service (orally, in writing, by email, or via the website contact form) and the Coach confirms the booking. Booking a free initial consultation does not constitute a contract for paid services.

3. Description of Services

The coaching services offered include, in particular:

– Individual coaching (60 min, online or on-site): €120 per session
– 5-session package (5 × 60 min incl. interim evaluation): €550
– 10-session package (10 sessions incl. documentation): €990
– Team workshop (180 min, from 5 participants): €450
– Initial consultation (30 min): free of charge

Coaching is not psychotherapy and is not a substitute for medical or therapeutic treatment. It is a professional accompaniment to support personal and professional development.

4. Appointments and Delivery

Coaching appointments are arranged individually. Online sessions are conducted via a video conferencing platform provided by the Coach. It is the Client's responsibility to ensure a stable internet connection. The Coach is not responsible for technical issues on the Client's side.

5. Cancellation Policy

– Free cancellation or rescheduling is possible up to 24 hours before the scheduled appointment.
– For cancellations less than 24 hours before the appointment or in case of no-show, the full fee will be charged.
– The Coach reserves the right to cancel appointments due to illness or force majeure. In such cases, an alternative appointment will be offered or the payment already made will be refunded.
– Package bookings (5 and 10 sessions) must be redeemed within 6 months of the purchase date, unless otherwise agreed.

6. Payment Terms

– Individual sessions are to be paid in advance or immediately after the session.
– Package prices are due in full upon booking.
– Payment is made by bank transfer or cash. Invoices are sent by email.
– All prices are in euros and are VAT-exempt pursuant to the Austrian small business exemption (§ 6 para. 1 no. 27 UStG).
– In case of late payment, default interest at the statutory rate (4% p.a. for consumers) will be charged.

7. Confidentiality

The Coach undertakes to maintain confidentiality regarding all personal information disclosed during the coaching process. Excepted from this are statutory disclosure obligations (e.g. in case of danger to life and limb).

8. Client Responsibilities

Coaching success requires active participation. The Client is responsible for implementing the insights and actions developed during coaching. The Coach does not guarantee specific results.

9. Liability

– The Coach is only liable for damages caused by intent or gross negligence.
– Liability for slight negligence is excluded to the extent permitted by law.
– Liability for indirect damages, loss of profit, or consequential damages is excluded.
– These liability limitations do not apply to personal injury.

10. Right of Withdrawal

Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) have a right of withdrawal pursuant to the Austrian Distance and Off-Premises Contracts Act (FAGG). Details can be found in our Withdrawal Policy.

11. Intellectual Property

All materials, worksheets, concepts, and documents provided during the coaching process are protected by copyright and may not be passed on to third parties, reproduced, or published without the express permission of the Coach.

12. Applicable Law and Jurisdiction

Austrian law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For disputes with consumers, the statutory jurisdiction pursuant to § 14 KSchG (consumer's place of residence) applies. For businesses, the place of jurisdiction is Korneuburg.

13. Severability Clause

Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The legally permissible provision that comes closest to the economic purpose of the invalid provision shall apply in its place.

14. Amendments to these GTC

The Coach reserves the right to amend these GTC at any time. For existing contractual relationships, the GTC valid at the time of conclusion of the contract shall apply. The current version is available at coaching-weinberger.at/en/terms.
